PLANNING BOARD DISCUSSION: Provide funding toupdate Canton Master Plan which was
created in2004. Canton has been successful and implementing many ofthe recommendations within the
2004 Master Plan. However, alotofdevelopment has happened inthe past 12years.The 2004 Master
Plan ismissing some ofthe more recent best practices which many municipalities now include intheir
master plans. The background data isdated and does not reflect the most recent decennial census and
local data. The goals are now nolonger tied into the Capital Improvement Plan.Athoughtful Master Plan
canhelp ease uncertainty byensuring Canton will remain both anenvironmentally sound and fiscally
healthy community.

FINANCE COMMITTEE DISCUSSION: The Finance Committee voted unanimously to support
transfer of $150,000 from Free Cash topayforupdating the Town Master plan. The purpose ofaTown
Master Plan istocapture the Town’s long-term goals for future growth and preservation. The current Town
Master Plan was last updated in2004 and since much has happened inthat time, the Finance Committee
felt developing anupdated plan was well-warranted. The Finance Committee hopes that the update ofthe
Master Plan willbecoordinated with the planning processes being funded under the Community
Preservation Act.

Planning Board

PLANNING BOARD MOTION:
MOVED: That the Zoning By-law be amended by adding anew Section 7.8 as follows:

7.8 Temporary Moratorium onthe Sale and Distribution of Recreational Marijuana.

7.8.1Purpose: By vote at the State election on November 8,2016, the voters of the
Commonwealth approved alaw regulating the cultivation, distribution, possession and use of
marijuana for recreational purposes. The law provides that itiseffective on December 15, 2016
and the Cannabis Control Commission is required to issue regulations regarding
implementation by September 15, 2017. The time period for issuance of the regulations by the
Cannabis Control Commission has been extended bysix months to March 15, 2018.

Currently under the Zoning By-law, Recreational Marijuana Establishments and Marijuana
Retailers are not a permitted use in the Town and any regulations promulgated by the State
Cannabis Control Commission are expected to provide guidance to the Town in regulating
Recreational Marijuana Establishments and Marijuana Retailers.

The regulation of Recreational Marijuana Establishments and Marijuana Retailers raises novel
and complex legal, planning, and public safety issues. The Town needs time to study and
consider the regulation of Recreational Marijuana Establishments and Marijuana Retailers and
address such novel and complex issues, as well as to address the potential impact of the State
regulations on local zoning and to undertake aplanning process to consider amending the
Zoning By-law regarding regulation of Recreational Marijuana Establishments and Marijuana
Retailers and other uses related to the regulation of recreational marijuana. The Town by this
Section 7.8adopts atemporary moratorium on the use ofland and structures in the Town for
Recreational Marijuana Establishments and Marijuana Retailers so as to allow the Town
sufficient time toengage in aplanning process to address the effects ofsuch structures and
uses in the Town and to adopt provisions of the Zoning By-law in amanner consistent with
sound land use planning goals and objectives.

7.8.3Temporary Moratorium.

For the reasons set forth above and notwithstanding any other provision of the Zoning Bylaw to
the contrary, the Town hereby adopts atemporary moratorium on the use of land or structures
for Recreational Marijuana Establishments and Marijuana Retailers. The moratorium shall be in

                                  PLANNING BOARD VOTE: 4-0

FINANCE COMMITTEE MOTION:
MOVED: The Finance Committee recommends that the motion presented by the Planning
Board toTown Meeting for Article 52 as written inthe warrant be adopted.

                               FINANCE COMMITTEE VOTE: 6-0-2

PLANNING BOARD DISCUSSION: Amended tocreate atemporary moratorium on registered
marijuana establishments until the state finalizes regulations. Atthat time, the town through its Town
Meeting and upon recommendation ofthe Planning Board will adopt zoning regulations consistent with
state statute.

FINANCE COMMITTEE DISCUSSION: Last November, the voters approved areferendum tolegalize
the personal use ofmarijuana for non-medical purposes. The voter referendum requires the state to
                                                                                      th
establish aCannabis Control Commission, which will enact regulations bynext March 15 with respect to
growing, processing, and selling marijuana. The referendum question approved by the voters has a
number of ambiguities and there are currently approximately 40bills filed with the legislature to amend
portions ofthe new law. Because oftheuncertainties astowhat theregulations and amendments tothe
law may provide, the Planning Board has proposed atemporary moratorium onany non-medical
marijuana facilities intown. Many other municipalities are considering the same approach. The Finance
Committee concurs that atemporary moratorium isinthe Town’s best interest sothe that the Town will
have time toengage inathoughtful planning process for zoning regulations for this newly-allowed use,
after any amendments tothe law have been passed and the regulations are enacted.

PLANNING BOARD DISCUSSION: Rezoning conservation land (e.g.Department ofConservation
and Recreation, Trustees ofthe Reservation, and Town ofCanton) inthe Zone IIpublic water supply
wellhead area toprotected open space will clarify our zoning map, and preserve potential future water
supplies asrecommended inthe 2004 Canton Master Plan, Chapter 11 Implementation, Section 1Zoning.
These parcels have noconflicting uses, and are ineither Zone IIareas, groundwater protection zone,
watershed, wetlands, orflood zones. However, these public lands are currently zoned either single-
residence, industrial, orlimited industrial districts, which isinconsistent with their current and future use.

FINANCE COMMITTEE DISCUSSION: With a7-0-0vote, the majority ofthe Finance Committee
supports the Planning Board motion, which has the impact ofamending the zoning ofthe listed parcels to
