sections:

                                                 VOTE: 5-1-1

MAJORITY DISCUSSION: Amajority ofthe Finance Committee voted tosupport this change tothe by-
law. The federal government has changed the Clean Water Act toreduce the amount ofland that isdisturbed that
requires apermit from 21,000 sqfeet (one half acre) to5,000 sqfeet. This change puts Canton infull compliance
with the federal Clean Water Act.

MINORITY DISCUSSION: The minority feels that lowering the minimum value to5,000 square feet istoo
restrictive. A50by100 foot parcel ofland meets this minimum value. Ahomeowner wishing toredo hislawn, put
inanew garden, orreplace his driveway might easily disturb this small amount ofland.

Inaddition, the authority granted inSection 3ofthis By-Law, allowing the Commission topromulgate rules and
regulations toimplement this By-Law istoo vague. The Conservation Agent could not bespecific onthis subject.

Members who miss only one session ofahearing tovote on the matter, provided that the Board member certifies
inwriting that he/she has examined allthe evidence received atthe missed session, including the audio/video or
transcript ofthe missed session, and that this certification be included inthe record ofthe hearing. Apositive vote

                                                 VOTE: 5-0-2

DISCUSSION: The Finance Committee supports the adoption ofthis Article. The change inthe by-law requires
the owner ofaproperty toappear before the Historic Commission when applying for ademolition permit for a
Historically Significant Building orStructure. The intent ofthis change istoprovide the Historical Commission with
additional resources intheir quest todetermine ifthe structure has any historical importance. Typically adeveloper
and/orlawyer foraproject seeking ademolition permit are not familiar with the cultural history ofthe property
and cannot provide detailed information astohistorical relevance tothe Town.

This Article also requires the applicant toobtain allother required permits prior tothe Building Commissioner
issuing the permit for demolition ofaHistorically Significant Building orStructure. The intent ofrestricting the
actual demolition ofthe structure until such time istoavoid the demolition ofahistorically important structure until
the necessity and validity ofthe demolition isjustified bythe progress ofthe intended project.

The demolition permit for aHistorically Significant Building isonly valid for six months. Ifthe Building orStructure
isnot taken down orremoved within that time, the applicant must request anextension ofthe Historic
Commission' sdecision. The intent ofthis change istoprovide the Historic Commission an opportunity towork with
anew owner inanattempt tosave the structure ortowork with the current owner toincorporate part orallofthe
structure into the new project plans.

DISCUSSION: The Finance Committee unanimously supports Article 41. This Article changes the Town’s By-
Laws toconform toarecently enacted change inMassachusetts General Law that increases the property tax
exemption by $200 for qualifying senior citizens. Asaresult, this change increases the exemption toamaximum
of $1,000. Itisestimated that there are approximately 120 people who qualify for such anexemption inCanton
today. Given the small effect ofsuch anadditional exemption onthe Town’s property tax revenues, and that itis
going tosupport taxpayers with modest financial resources, the Finance Committee voted toapprove this Article as
presented.
