DISCUSSION: The Finance Committee unanimously supports this article. The Town adopted
chapter 43D Expedited Permitting at the 2007 Annual Town Meeting and designated 2 parcels as
Priority Development Sites. Those actions have resulted in state recognition of Canton' s pro-business
attitude, increased visibility to business ventures looking to locate in the Boston area and improved
the Town' s position in attracting new commercial and business development. The three parcels
contained in this article build upon the 2 parcels approved at the 2007 town meeting.

DISCUSSION: As has been the
practice at previous Town Meetings, this article was placed on
the warrant in anticipation of may be in the General
legislation that Court ( Legislature) and that could
benefit the Town of Canton. This Article allows the Town to support or reject, at Town Meeting, any
legislation that emerges from the General Court prior to Town Meeting. Since no laws enacted by
General Court and benefiting the Town of Canton came forward, and none was anticipated, the
Finance Committee voted to have the subject matter of this article withdrawn from consideration and
action on this warrant article indefinitely postponed.

AUTHORIZE INTERMUNICIPAL AGREEMENT WITH THE TOWN OF MILTON FOR WATER
Article 28 To see if the Town will vote to authorize the Board of Selectmen to enter into along-term
Intermunicipal Agreement with the town of Milton to provide water to North Canton and to update the
Agreement of March 9, 1953 between the towns of Milton and Canton relating to water supply, or to
take any other action related thereto.
Board of Selectmen
MOVED: That the subject matter of this article be indefinitely postponed.
VOTE: 9-
00-
DISCUSSION: The Finance Committee unanimously supports postponing this article
indefinitely. Provision of water via the Town of Milton for approximately fifty-three ( 53) Canton
properties has been ongoing for years. The renewal of an inter-municipal agreement according to
Town Counsel is needed. The existing Agreement signed in the 1950' s has long since expired. The
Town of Milton contends that additional water leaving Milton and entering Canton is unaccounted for
and not being properly reimbursed. An exhaustive system analysis by both towns was pursued but no
specific " source" of the unaccounted for water was discovered. To remedy the situation going forward
a number of compromises are being considered. However, at the time of this warrant, no agreement
had been reached.

or to take any other action related thereto.
Board of Selectmen
MOVED: That the subject matter of this article be indefinitely postponed.
VOTE: 9-

DISCUSSION: The
general premise of this article is an attempt to promote traffic safety thru
the installation of traffic control
signal violation monitoring systems (modular cameras). Public notice
would be provided indicating that a particular area or intersection/location was to be monitored and
activity recorded. Tickets would be issued by mail to the owners of vehicles committing traffic law
violations. The US Conference of Mayors and the International Association of Chiefs of Police have
expressed their support for such a program and certain cities ( Springfield and Lawrence) within the
Commonwealth have passed local ordinances authorizing the use of these cameras. It has been
stated that a major citizen complaint in town is traffic safety and statistics have demonstrated that
use of this program can reduce traffic deaths and injuries.
This has been described
as a mechanism that will allow for greater traffic enforcement and safety
efficiency in a self
supporting manner as collected monies resulting from violations should be sufficient
to offset purchasing and administrative costs. Finance Committee members questioned whether all
potential expenditures were considered in evaluating the self- sufficiency of the proposed system.
Areas of concern included the necessity for added personnel, utilization of police resources in
adjudicating contested violations, privacy issues and other potential funding issues.

AMEND ARTICLE XIV, SECTION 43 -HOURS OF OPERATION OF HEAVY EARTH MOVING
EQUIPMENT
Article 31 To see if the Town will vote to amend the Town' s General By- Laws, as most recently
amended, by changing the permitted hours of operation of heavy earth moving equipment to limit
hours of operation on Saturdays and exclude operation on Sundays and holidays in Article XIV,
Section 43, so that the new text would read as follows, or to take any other action related thereto.
Section 43. Hours of Operating Earth Moving Equipment
No person shall
operate heavy earth moving equipment or vehicles within the Town on any weekday
Monday - Friday) except between the hours of 7:00 A.M. to 6:00 P. M., nor on any Sundays or
Massachusetts state holidays ( Saturday hours shall be established from 9 A. M. to 3 P. M.), except in
the event of emergency or for public safety purposes, in which case such person has first applied
application fee to be set from time to time by the Board of Selectmen) to and received from the
Board of Selectmen or designee, an express written Emergency Waiver of Time Limits waiving
compliance with this Section 43. For the purposes of this Section 43, heavy earth moving equipment
and vehicles shall include, but not be limited to backhoes, bulldozers, dump trucks, cement mixers
and equipment and vehicles used in or for excavating, filling, transporting, holding, moving or
removing soil, loam, sand, gravel, stone, clay, sod, minerals, organic matter, debris, construction
materials or other earth materials or compounds. Persons found in violation of this section may be
fined not more than two-hundred dollars ($200.00) for each offense. Each day that such violation
constitutes shall constitute a separate offense.
Board of Selectmen
MOVED: That the subject matter of this article be indefinitely postponed.
VOTE: 7-

DISCUSSION: The Finance Committee believes the intent of this Article is to regulate the use
of heavy earth moving equipment in an effort to reduce undue noise and disruption to neighboring
properties on the weekends. The Finance Committee recognizes the potential merits of this article but
questions the ambiguous definition of "heavy earth moving equipment", how the proposed change
differs from the current By- Law, and whether the property owner or the equipment operator would be
responsible for payment of fines imposed. The Board of Selectmen did not attend any Finance
Committee meetings prior to the voting deadline and without sufficient information to resolve its
concerns, the Finance Committee voted to postpone Article 31 indefinitely.

DISCUSSION: This article allows the Town to acquire the title to a parcel of land for which the
Town already holds an easement. In a summary memo the Board
provided of Selectmen to the
Finance Committee, they indicated that no costs are to be
by the Town of Canton
expected incurred
relating to this acquisition. The Town is expected to benefit from this article by ensuring that the
Town has safe and reliable access to the fields and a field house under the supervision of the Board of
Selectmen, off Route 138.

ANNUAL TOWN MEETING APRIL 28, 2008
The Finance Committee recognized the potential merits of this article to the Town but questioned the
conflicting language in the article and the summary memo provided by the Board of Selectmen. The
memo suggested that the Town would incur no cost but the article authorizes the Board of Selectmen
to "acquire by purchase" said parcel of land. While the article language may have been incorporated
to legally convey this property for the sum of ($ 1. 00) one dollar, Finance Committee members were
concerned that approval of this article, as written, would authorize the Board of Selectmen to enter
into a contract with less favorable terms. The Board of Selectmen did not define the terms of the
transaction or make themselves available to the Finance Committee, prior to the voting deadline, to
clarify the costs for this article, or the benefits that would be added beyond those offered by the
existing easements. Without sufficient information to resolve its concerns, the Finance Committee
unanimously voted to postpone Article 33 indefinitely.

DISCUSSION: The 2007 Legislature amended MGL. C. 41, sec. 1000 1/4 to increase to
15,000 the amount of funeral and burial expenses to be paid by a city or town in cases where a
firefighter or police officer is killed in the line of duty or dies from injuries received in the line of duty.
The 1988 Annual Town Meeting (Article 58) had approved the local option of this law with a maximum
amount payable of $5, 000. This year's article simply increases the maximum amount paid by the
Town, putting the Town in agreement with the Massachusetts General Law. The Finance Committee
unanimously supports the adoption of Article 37.

TRANSFER OF FUNDS TO MEET FY 09 APPROPRIATIONS
Article 40 To see what sum the Town will vote to transfer from Free Cash in the treasury to meet
the appropriations for the ensuing Fiscal Year and to authorize the Assessors to use in fixing the rate,
pass any vote, or to take any other action related thereto.
Board of Selectmen for the Finance Committee
MOVED: That the sum of Nine Hundred Thousand Dollars ($900,000) be transferred
from Free Cash in the treasury of the Town to the Stabilization Fund.
VOTE: 5-
04-
MAJORITY DISCUSSION:
Town Reserves, which are funds set aside for town-wide emergencies and to cover unforeseen one-
time budget shortfalls, are composed of three elements: Monies contained in Free Cash Reserves,
Overlay Reserves Account and the Stabilization Fund. A simple majority vote is required at Town
Meeting to access funds held in Free Cash whereas a two third's majority is needed to move funds out
of the Stabilization Fund. Town meeting cannot access the Overlay Reserves account.
It is the belief of the Finance Committee that sound fiscal policy warrants that sufficient funds be
contained within the Free Cash Reserves and the Stabilization Fund to deal with unforeseen
emergencies. The transfer of $900,000 from Free Cash to the Stabilization Fund does not change the
percentage of funds held in reserves but does offer greater protection for funds needed to deal with
unforeseen emergencies. It also sends a clear, positive message to the bond rating agencies that the
Town is serious in protecting its bond rating, which has a direct impact on minimizing the level of
interest expense incurred on debt obligations.
The Finance Committee voted 4-in favor
5-
0 to support this article.
MINORITY DISCUSSION:
The Finance Committee unanimously believes that sound fiscal policy requires the Town to hold
sufficient reserves in Free Cash and Stabilization. The Stabilization Fund and " Free Cash" are
components of the town' s reserves and are essential to
provide a cushion in the event of an
emergency. Appropriations from free cash require a majority vote, while appropriations from the
stabilization require the approval from 2/3 of the voters.
fund At the time the Finance Committee
was required to vote on this article, they had not concluded discussions on the Budget and the
pending override, so implications as to the use of Free Cash could not be determined at this time.
Some members of the Minority felt more comfortable that a smaller appropriation to the Stabilization
Fund was a reasonable compromise and a motion was made to amend theoriginal motion and
appropriate $500,000 to the Stabilization Fund. The amended motion failed to pass by a vote of 4-
5.
