Hi Charlene,
It should, as the grant is not a supplement for the project. It's a primary funding source that was unanticipated when
the project was authorized.
Would you know if I need to reduce the authorization at a Town Meeting by the grant amount, or can I just reduce it
automatically?
Thank you, Randy

Washington St & Bolivar St Cases
That's great news Gene!
Sorry to bring a wonky municipal finance procedure to bear, but we need to follow the law on this.
Specifically, when the BOA votes to release Overlay funds, those funds are then required to be released into the
"Overlay Surplus" account.
Funds can not be spent out of Overlay Surplus.
Funds in the Overlay Surplus account would need to be appropriated at a Town Meeting for any legal purpose (e .g.,
legal services).
I've cc'd Allyson on this email so that she is aware that $75K should be reclassed from Overlay to Overlay
Surplus. She'll need a copy of the vote for her accounting/audit records.
I will make a note to bring forward a warrant article at the next Town Meeting to fund the intended legal services
from the Overlay Surplus account.
In the meantime, assuming Allyson doesn't have an issue with my suggestion, I suggest she establish a separate
account within the Assessor's budget for the sole purpose of paying these legal services expenses.
The Assessors could "deficit" spend out of that account for now. Then at Town Meeting we will ask for a vote to fund
that account from Overlay Surplus.
Let me know if any questions or concerns.
Thank you, Randy

Good Afternoon Charlie,
As you know, I have been working on the Land Court petitions for the three orders of taking that require new
certificates of title to be issued to the Town. I was informed by the title examiner assigned by the court that Division
Plans also need to be filed for two of the cases, which require a survey to be completed by a Registered Land Surveyor.
After requesting quotes for the plans from the Registered Land Surveyor that Alfons recommended, Greg Bunavicz, he
informed me these plans will require extensive surveys due to the size of the parcels involved. Attached to this e-mail is
the quote I received for the Washington Street plan, I am still waiting to receive the quote for the Bolivar Street plan.
Unfortunately, these cases cannot proceed without the division plans being filed with the Court. I spoke with the title
examiner recently and she confirmed this, and also informed me that the court may require the cases to be refiled if the
division plans will not be filed in the near future. Please review the quote attached to this e-mail and advise how to
proceed. I am available the rest of the day today and in the office all day tomorrow for a phone call to further discuss
this as well.
Thank you,

ARTICLE 18
APPROPRIATION TO INCREASE CAPITAL STABILIZATION ACCOUNT
Article 18 To see if the Town will vote to raise and appropriate or transfer from any available funds or borrow
pursuant to any applicable statute, a sum of money in order to increase the Capital Stabilization Account, or to
take any action related thereto.
Select Board
MOVED: That the sum of One Million Dollars ($1,000,000) be appropriated to the Capital Stabilization
Account (#801) and to meet this appropriation, One Million Dollars ($1,000,000) be transferred from
Free Cash (Undesignated Fund Balance) in the Treasury of the Town.
FINANCE COMMITTEE VOTE: -
Draft Discussion based on last year's discussion.
FINANCE COMMITTEE DISCUSSION: The Finance Committee unanimously voted to support the transfer of
$1,000,000 from Free Cash to the Capital Stabilization Fund for future capital projects. Annual Town Meeting 2022
established the Capital Stabilization Fund with a transfer of $1,000,000 from Free Cash. Stabilization Funds provide
the Town with the opportunity to set aside funds for specific uses. This funding will help to offset the future debt
service costs of the new Galvin Middle School renovation/rebuild project. This account will require a 2/3 vote of
Town Meeting for withdrawals, but only a majority vote for deposits.
