Chapter 43D: Local Expedited Permitting
|CANTON|
Program Purpose
Creating prompt and
predictable permitting is a key
element of Planning Ahead for
Growth. Local expedited
permitting is attractive to
developers, increases a
community’s visibility and is
rewarded by preference in
discretionary funding.
Eligibility
To be eligible for 43D
designation, a municipality must
provide for local permitting
decisions on its designated
priority development sites within
180 days of a complete
application.
With 15 sites designated, the Town of Canton has been one of the most active participants in the
Chapter 43D Local Expedited Permitting program. Recognizing the benefits of prompt and predictable
zoning and permitting, the town has made a concerted effort to communicate to businesses and
developers the specific locations where the community would like to target growth.
Canton’s 43D Sites: By the Numbers
• 11 out of 15 43D sites are currently occupied
• In total, these properties constitute $38M in commercial real estate valuation
• These sites have generated approximately $850K in local taxes
Below are 2 examples of recent developments at 43D sites in Canton:
150 Dan Road – designated as 43D site in 2012. In 2013 Organogenesis leased approximately
190,000 square feet at this site in order to move its headquarters and manufacturing operations to
Canton.
465 Turnpike Street – designated as 43D site in 2013. sold/being redeveloped.

CHAPTER 43D
HISTORY
In August 2006 Chapter 43D Permitting was enacted into law,
establishing a process for the designation and tracking of Priority
Development Sites (PDS) on which municipalities offer a maximum of 180 day
local permitting process. Cities and towns that opt into the Chapter 43D Program
are able to target areas, through a streamlined local permitting process, for
housing and economic development. As of February 2014, the 43D Program has been adopted by 86
municipalities on 179 sites.
THE BENEFITS OF OPTING-IN
• Priority consideration for the MassWorks Infrastructure Program grants, brownfields remediation
assistance, and other financing through quasi-public organizations
• Online site marketing and promotion of a community’s pro-business regulatory climate
• Improved municipal planning and permitting efficiencies
• Collection of special fees for priority development site permit applications
THE CRITERIA FOR PRIORITY DEVELOPMENT SITES
• Zoned for commercial, industrial, residential, or mixed use development
• Eligible for the development or redevelopment of at least 50,000 square feet of gross floor area
(may include existing structures and contiguous buildings)
• Permission has been granted by the property owner (if private) for participation in the program
• Approved by the local governing authority and the state Interagency Permitting Board
THE OBLIGATIONS OF OPTING INTO CHAPTER 43D
• Within 120 days of adopting Chapter 43D, the community must
• appoint a single municipal point of contact for streamlined permitting;
• amend local rules, regulations, bylaws, etc. to comply with 180 day permit timeline;
• determine and make available the requirements for each permit;
• establish a procedure for identifying necessary permits for a project;
• establish a procedure for determining completeness of the required submissions.
• After the 120 phase-in period is complete, the town must render permitting decisions on priority
development sites within 180 daysSource page 3
