Mr. Plante again, introduced him along with Sarah Ebaugh of VHB. The Town is the owner of
the property and he has agreed to design, construct, and obtain the permits for this project.
They purchased the 120,00 square foot lot from the prior owners and the house was razed. He
is working with Alfons, the Town Engineer, and this lot will aid the Washington Street
retailers. There are multi -family units on all sides and they have also submitted the Plans to
Zoning. They are proposing eleven (n) parking spaces with one (1) way in and one (1) way
out. There will be two (2) electric charging spaces, one (i) accessible space; and eight (8)
regular parking spaces. They will add catch basins, are not changing the conditions, with no
impact to the abutters, There will be signage, landscaping, bituminous sidewalks, raised
driveway aprons, a landscape island, and a small retaining wall. There will be no additional
lighting.
Chair McCarthy was concerned with no lighting in this area, and if there are any restrictions
on parking. He believes there should be a limited time period.
Mr. Plante explained that this is for Town parking, and there have been no discussion yet on
parking times. This is municipal parking and there will be required signage with specifics
pending Alfons's final review.
A motion was made by Chair McCarthy and seconded by Mr. Quigley to Approve the creation

HEMENWAY DRIVE CANTON — ANR Plan — (Arthur & Susan Murphy, Owners;
Marion V. McEttrick, Atty., Milton, MA)
Attorney McEttrick introduced herself and she represents Mr. & Mrs. Murphy and has been
before the Board since last May. She has reviewed the By -Laws and submitted a response
letter representing the Applicants. She has done a lot of research on the issue of this ANR and
whether there is access to Avenue A. This ANR Plan was been approved and signed by the
Milton Planning Board in March and again in October of 2024 due to some minor labeling
changes on the Plan. She is just asldng the Board if they agree with this ANR Plan or not.
Milton has different frontage requirements than Canton does. Milton approved the Plan with
no road; no access; no frontage; and she feels that this is determined by Milton since this is the
access to the property. Attorney McEttrick explained that this lot was split back in 1865
before Zoning was even adopted and it is a six (6) acre parcel. The Murphy's purchased the
property in 2016, and there is a two (2) lot restriction. They are only trying to create one (1)
additional house lot and she hopes the Board understands.
Attorney Christopher Alton of Attorney Silverstein's office stated that the only question is, if
the abutting Town approves, where will the house be built.
Chair McCarthy explained that all determinations require uses for each district for each Town.
He also stated that he will listen to the abutters comments but he doesn't need to hear about
the plants, animals, and asks that t he abutters limit their comments.
Nick Vinke of 5o Hemenway Drive explained that he has worked on this since 2016 and
explained the improvement Plans; the culvert issue; determination of the wall; and that the
existing house is in Canton. There is no frontage or access in Canton, only from Milton.
Carl Cummings of 5o Hemenway Drive stated that this is clearly not a subdivision and not
adequate for these purposes.
Chair McCarthy explained that all those issues are not under the purview of the Planning
Board and is not relevant to Canton, only the ANR.
There were no comments from the Board.
Attorney McEttrick stated that we are not going to go forward with this ANR Plan and
requested that she would like to withdraw her application without prejudice.
A motion was made by Ms. McDermott and seconded Ms. McCormack to accept the
Withdrawal of this ANR Application without prejudice for 85 Hemenway Drive. All in Favor,
Motion for Withdrawal Approved 5-0.
A motion was made by Ms. McDermott and seconded Mr. Quigley to open Item #4, 240
Turnpike Street. All in Favor, Motion Approved 5-0

Next Item on the Agenda (5) 24o TURNPIKE STREET (Judge Rotenberg
Educational Center) — Site Plan and Stormwater Review for Proposed Parking Lot
Expansion Project (Nick Magill, Applicant; Robert R. Pellegrini, Esq., Bridgewater; Gregory
Driscoll, P.E., JDE Civil, Inc., Civil Engineer),
Attorney Pellegrini introduced himself, along with Greg Driscoll; Nick Magill; Dylan Palmer;
Amanda Langer; and Emily Buck. He gave a quick overview of the Application and explained
that this is a Limited IB Zone, surrounded by Industrial and residential behind the property.
They created a site plan in October 2022 and added seventy (70) parking spaces behind the
existing building, down from eighty (8o) spaces. There is a reduction in tree removal and
reduced the distance from the existing building to the residential setback from 146' to 164'.
They took the original plan and modified it with Planning Board recommendations. They are
putting in a new gravity sewer system; updated the stormwater management system; added
dark side lighting; created more landscaping; worked with a landscape architect; and added an
acoustical sound barrier. They have also added ADA parking which meets the required
regulations; eliminated rear basins; did a more in-depth review of the drainage; and added
seventy (70) spaces; and have improved circulation.
Greg Driscoll presented the new Site Plans and stated that he has addressed all comments;
worked with Alfons and reviewed PSC's reports.
Chair McCarthy had concerns with no changes into the entrance to the property from
Turnpike, and only grade changes were made. They did not change the flow since this is a
narrow entrance.
Emily Buck, Traffic Engineer, explained that they had peals periods observations; created
traffic counts; reviewed employee parking; collected a week's data to each entrance, and now
have an understanding of the use.
There are 183 spaces available to the front and back lots, with shift changes. They also
collected data with peak times on Tuesdays; M-F Rt. 138 — Max of 186 cars. She will send
another email to the Fire and Police Chief to get this input and comments.
Mr. Quigley had concerns with the parking and asked if they have outgrown the building and if
there is any other place to park vehicles. Is there a compelling reason to increase the parking
and it is necessary to upset the neighbors.
The Applicant explained that it is not functional to have the vans and buses offsite. They have
55 vans and rotate out seven (7) at a time which are completing different routes. There is no
other place to park them and at other residential homes they don't own the properties. This is
also used for parking for teachers and staff of the facility.
Chair McCarthy was concerned with Fire equipment getting around to the back of the building
and feels the traffic flow has not changed. This area is awkward and cumbersome, and would
like to hear from the Fire and Police Chiefs.

Attorney Matthews presented a memo to the Board today, and understands it is last minute,
but feels the applicant has not made any advances and the situation is still the same. They
have still failed to determinate the number of parking spaces. She stated:
• There are no calculations for parking, and no square footage on the plan;
• The Plan does not have enough information;
• Is the address 240, 24oR, or 250;
• Are there 172 parking spaces, along with 20 in the upper lot;
• She feels the Board should review the last plan against the new plan; and
• What is the requirement for all the vans to be always parked there.
Dr. Palmer explained that it is burden on them to prove why they need to have more parking
spaces in order to run their business.
Juris Grauds of ig Autumn Circle stated that the study is not done correctly, it is not genuine,
and they need an alternative configuration.
Anthony Basille of 21 Autumn Circle stated that he feels the applicant has outgrown the
facility. And the traffic study was not done correctly and they missed the peak hours.
A motion was made by Ms. McDermott and seconded Mr. Quigley to continue this hearing
until November 20, 2024. All in Favor, Motion Approved 5-0).
A motion was made by Ms. McDermott and seconded Mr. Quigley to open Item #6, Minutes.
All in Favor, Motion Approved 5-0).
