and Zoning— (Greg Pando, Zoning Board of Appeals
Mr. Pando, Chair of the Zoning Board of Appeals thanked the Board for having him here
tonight. He explained that the street acceptance article for Saddleback and Horseshoe Lane
was voted down at the Town Meeting 2024. The Applicants will be reapplying and have a copy
of the 2012 Town of Canton Policy on Street Acceptance and it contains very clear steps for
obtaining acceptance. Mr, Pando suggested that the Applicants apply through the Planning
Board and the Town will do a revised report which includes all the Subdivision Rules &
Regulations, which will be reviewed through the Planning Board; Public Works; and the
Engineering Department.
There is a lengthy history to this project which went before the Zoning Board in 2010 as a
Special Permit under a 4oB, They were granted forty (40) waivers and this was a private
development. One of the conditions of approval was that the road was to remain private. The
Decision was appealed on Remand and the Judge denied only one of the waivers and this one
comment was "Private Road" which was removed. The project was built, sold, and never
inspected by anyone. Once completed the As -Built was submitted. We need to review this
project and look at the following:

• Proper base course;
• Appropriate thickness of the road, along with core testing;
• Camera examination of the sewer;
• Camera examination of the drainage system;
• All telephone lines;
• All Utilities;
• All street lights;
• The two (2) existing drainage districts;
• Internal basin transfer of water;
• WMRA (water quality) and Canton water going to Randolph sewer.
We need to get Engineering involved and see what the deficiencies are and get a final cost
amount to bring this up to the standards of the Town. We can then talk about a betterment.
We also need to have site line discussion and we understand the HOA is not able to maintain
the pumping station.
Mr. Quigley was concerned if the waivers tie our hands in any way.
Mr. Pando explained that we need to go through all the waivers and be proactive and hopefully
by the next Town Meeting, we will have had time to investigate this process. The first move is
for the Residents to move forward and get the process started.
Ms. McCormack arrived at 6:23 p.m.
A motion was made Chair McDermott and seconded by Ms. McCormack to open Item #2,
Hemenway Drive (ANR). All in favor, Motion Approved 4-0.
Next Item on the Agenda (2) - i4a4 BRUSH HILL ROAD, MILTON, aka 8a
HEMENWAY DRIVE CANTON - ANR Plan - (Arthur & Susan Murphy; Owners)
Attorney Marion McKendrick introduced herself as representing the owners, Arthur and
Susan Murphy, who are in attendance. The owners purchased the property in 2015. There are
two (2) addresses and they pay taxes in both towns. These lots were created in 1912 with
access only through Milton. They are hying to create an additional lot in the rear and since
the properties are located in two (2) towns, they need approval from both towns. This is a 6.5
acre lot with an existing house, with a restriction that they cannot create more than two (2)
buildable lots. Milton determined that this has frontage.
The Board stated that there is no frontage in Canton, which requires vital access, and doesn't
qualify as an ANR. This could go before Zoning and try to obtain a variance.
Mr. Houston suggested seeking relief from the Zoning Board and then coming back to the
Planning Board.
A motion was made Chair McDermott and seconded by Ms. McCormack to close the hearing.
All in favor, Motion Approved 4-0,

Petroleum Hydrocarbons. This lot will have frontage on Revere Street. They are taking some
land from Lot 8; adding it to Lot 15; and labeling this lot non -buildable due to the toxic nature
of the soil. Lot 8D will have 39,685 square feet; and Lot 8 will have 152,209 square feet of
land,
A motion was made by Chair McDermott and seconded by Ms. McCormack to Approve this

Agreement with the Town dated 2015 and amended seven (7) times. They have added two (2)
dog parks; a wetland buffer; and reduced the developed area under an alternative plan. They
are proposing Building #5, a 63 unit building, and are looking for a recommendation from the
Planning Board. This will be a single, multi -family, five (5) story building with a garage under.
The building will be approximately 120,000 square feet with 115 parking spaces (which
exceeds the Zoning requirement). The stormwater management will be shared with Lot 9.
They have received Tom Houston's comments and are still going over this review, and will be
meeting with the Police and Fire Departments.
Pat Danford has prepared a Transportation Study and has prepared prior studies. He
prepared this study in June of last year including 2024 condition which also goes seven (7)
years into the future, on how much traffic will be generated. The traffic impact is minimal and
Intersection A has very good site distance and stormwater water.
Mr. Plante explained that this is a very attractive area to the commuter rail; great site line;
internal roadways; a great design; and age restricted for 55+.
Mr. Houston explained that they have read the comments and going through this in fine
detail; blends nicely into the area; and there is no dramatic impact to this location. There is
lower runoff post development and he doesn't see any issues.
