2. STORM WATER POLICY
The Chairman announced that the Commission had adopted a new storm water
policy at the May 18, 2000 meeting. The Chairman read the text of the policy
into the record. The policy is as follows:
In order to better treat and detain storm water, the Canton Conservation
Commission requires that applicants meet the EPA Phase II Storm Water
BMP Standards. The use of constructed wetlands for treatment and
detention of storm water from all subdivisions and commercial projects,
whenever possible is required to meet the standards. All other water
quality measures such as the removal of suspended solids, oil and gas shall
occur prior to the discharge of storm water into the created wetland area.
The constructed wetlands shall be designed and planted in a manner,
which minimizes maintenance and maximizes the removal of nutrients,
hydrocarbons, suspended solids and heavy metals. Species of wetland
vegetation planted in the artificial wetland shall have high pollutant
removal efficiencies and shall be a native species and not a nuisance
species such as phragmites or purple loosestrife.

The Chairman explained that one of the reasons for the new policy was due to the
EPA Phase II Storm Water Permit ("MS4") which the town must secure by the
year 2003. This policy will help the town comply with the requirements of the
permit.

CONTINUATIONS:
JOE CIULLA — LOT I IB, LAUREL LANE — DEP #124-765
Mr. Ciulla was present. The restoration plan has been added to the Notice of
Intent plan. The Chairman noted that the planting list was acceptable.
Mr. Ciulla stated for the record that there was a lot of disturbance at the site
before he purchased the property and that is why he installed the fence in the first
place. Bob Murphy noted that this was a created wetland and the plantings had
already been started. There was further discussion.
The Chairman stated that there was 610 square feet of disturbed area. The penalty
is $10 per square foot, which would amount to a $6,100.00 penalty.
John Burke asked about the additional cost that the applicant was going to incur to
do the work. Mr. Ciulla stated that it would be approximately $4,000.00 to move
and reinstall the fence and between $1,800.00 and $2,500.00 for the plantings. He
stated that he did not have exact estimates.
John Burke suggested that the Commission possibly waive a portion of the fine
based on the cost of the work to be done. The other members concurred. Mr.
Burke asked the applicant to come back with written estimates of the work, that is
going to be done.
Motion made by John Burke to continue the hearing to June 21, 2000, seconded
by Dave McLelland.
Vote: Unanimous.
