Trust/ Ryan & Tara Fenner) (Eric Dias, Strongpoint Engineering; Richard Staiti, Attorney) Attorney Staiti is representing the Applicants Mr. and Mrs. Fenner and requesting ANR Approval for the parcel that was 25 Downs Avenue. This property has been in the family for years and the property was subdivided. The Town changed the address from Downs Avenue to Upham Street. Attorney Staiti went to the 911 committee to change the name back to Downs Avenue from Upham Street. This subdivision has existed since 1907, and the house was built in 1938, which predates zoning. New houses were built at the end of the street in the 9o's. Further, he has found evidence of snow plowing; rubbish collection; and access which are grounds for acceptance. A portion of this road has been accepted by the Town but this area of the street has not been accepted and listed as a private way. Chairman Scully explained that if the residences of the street wish to have their portion of the road accepted by the Town, they would have to go through the process to have this approved at Town Meeting for future repairs and upkeep.
