Mr. Connolly also noted that Ms. Ellcort could not be present this evening as she had to attend an election function. 7:00 — iJNDERGROiTND WIRING UPDATE —Barry McDonough - NSTAR Mr. McDonough gave an overview of the project and the projected timeline. He described the project in four phases: 1) Engineering 2) Excavation 3) Installing cable 4) Removing overhead equipment. He explained that the first phase was completed, and that the second phase is scheduled to begin at the end of next week, the week of March 31, 2003, and would last for approximately 109 days, finishing by the end of August. The project would be completed in fu11(all four phases) sometime in 2004. He noted that the hours of construction would be Monday through Friday from 9:00 a.m. unti14:00 p.m., and depending on the progress potentially on Saturdays from 8:00 a.m. until 12:00 p.m. He further noted that delays are expected on Washington St. from Neponset St. to Sherman St. but that NSTAR is working with Chief Bright and the Town to minimize those delays. He pointed out that there will be one lane in each direction open at all times, and that entrances to the businesses would be maintained and passable at all times. Mr. Friel confirmed that all individuals and businesses impacted had been notified previously in writing regarding the project, and would continue to be consulted along the way. Furthe~nore, Mr. Friel, with the Board's approval named Mr. Dan Teague as the contact person for residents with questions or problems on a daily basis. 7:15 PUBLIC HEARING —Pledge of License —Paul Schneiders, Captain and Sue Inc. d.b.a. The Luna Sea Mr. Schneiders said that he checked with the Alcoholic Beverages Control Commission (ABCC) on this "pledge of license". He claims ABCC confirmed its validity. The Board's concern is with the language utilized: the terminology used "assignment" versus "pledge." Mr. Schneiders acknowledges that such a pledge is more of a "gentlemen's agreement" rather than force of law, since the Town is the one who owns the license. Mr. Del Vecchio remarked that the Board is not approving an "ass b~nment," but rather the "pledge," He requests that the language in the agreement be altered to reflect that. Mr. Connolly suggested that they hold off until the language in the agreement is altered. Mr. Schneiders asked Mr. Friel to contact the ABCC to confirm this change of language.
