Dr. Alan Rapoport, Clerk
ALSO
PRESENT: Mr. John L. Ciccotelli, Health Director
Ms. Jane Pratt, Health Nurse
Ms. Karen D. Murphy, Recording Secretary
Ms. Slattery opened the meeting at 7:05 p.m. in the Salah Meeting Room, Memorial Hall, located at
801 Washington Street, Canton, Massachusetts.
CONTINUED: NEW TOBACCO PERMIT PROPOSAL
Tobacco Permit Request — Amy's Quick Pick, 1036 Turnpike Street, Canton, MA: Present were
Mr. Robert DeVoe and Ms. Amy DeVoe, the owners of RHD, LLC, d.b.a. Amy's Quick Pick, as well as
their attorney, Mr. Robert Burr.
This is a continued hearing. Mr. Burr stated that Mr. DeVoe formally purchased the business that
operated from the building on his property at 1036 Turnpike Street, Canton, MA in November 21,
2018.Atty. Burr presented copies of an application for a new Tobacco and Nicotine Product Sales permit
(Permit) dated November 28, 2018 and contended that his clients had, therefore met the 60 -day window
to apply for a re -issuance of the previous business owner's (Andalus Variety Mart) Tobacco and Nicotine
Product Sales Permit.
The Board of Health (Board) noted that it had received a letter dated June 1, 2018, addressed to the
Selectmen from the attorney for Andalus Variety Mart, the previous business, Atty. Paul Conley,
informing the Board of Selectmen that the variety Store was returning its alcohol license to the Selectmen
stating, in part, "As the proprietors [of Andalus Variety Mart] have been unsuccessful in their attempt to
sell the business and the establishment has closed its doors with no intention of conducting further
business in the Town..." . The Board contended that the Devoe's had not applied for the re -issuance of
the Andalus Variety Mart's Permit within the 60 -day window from the shuttering of the Andalus Variety
Mart's business, as provided in the Board's "Regulation of the Sale of Tobacco and Nicotine Products".
Further, the Board, in its statutory discretion, also contended that to issue a new Permit after it had
established a Town -wide moratorium on any new Tobacco and Nicotine Sales Permits would be counter
to the best interest of the public health of the Town of Canton.
Upon a motion from Dr. Goodman, seconded by Dr. Rapoport, the Board voted to close the hearing.
