Meeting Held in the Salah Hearing Room, 2nd floor, 801 Washington Street, Canton, MA
Acting Chairman Pando opened the meeting at 7:00 pm and reads the agenda.
Chairman Pando explains that one Board member, Gary Vinceguerra, has been
hospitalized, and therefore the continuations to be discussed will not be heard tonight
because he had sat in on those hearings previously. They will be moved to the next
meeting which will be January 24, 2019.
Peter B Ferry/Estate of Lorraine M. Ferry — 246 Washington Street—1-19-ENCB-
SP-V
Chairman Pando opens the hearing and reads the petition. Chairman Pando also mentions
this Board has a certified list of Abutters from the Town of Canton Board of Assessors.
Attorney Suzanne Mathews states that this is a very clear-cut simple case. The property has
two addresses, 246 Washington Street and 11 Pond Street. It was previously owned by
Lorraine Ferry. When Lorraine died and her children were selling the house they realized
the town had conflicting opinions on whether this property is a single family or two-
family. The Assessors Department has it listed as a two-family, but the Building
Department has it listed as a single-family. Attorney Mathews states that there are two
choices: to prove that it was a pre-existing non -conforming two-family, and to re-establish
it. The property was consistently a two-family with the exception of the last few years.
Attorney Mathews reads a memo which list street listings in five year intervals where the
property has had different family names from 1939 until 2018. Attorney Mathews states
that this establishes that historically it was a two-family and the family would like to
reinstate this two-family status. The family is not intending to do anything in order to sell
it. It is pre-existing non -conforming property and is consistent in that neighborhood. The
property doesn't meet the required lot area. Attorney Mathews would like a Variance so
that they would not have to go back and prove that this property was a two-family at a later
date. Chairman Pando states that he is familiar with the property. Chairman Pando states
the best way to do this is under Section 5.6 abandonment or non-use of a non -conforming
