Town of Tanton, . assay. nSdts N ZONING BOARD OF APPEALS MEMORIAL HALL 801 WASHINGTON STREET CANTON, MA 02021 TEL: (781) 575-6589 FAX: (781) 575-6574 Minutes of the meeting of July 26, 2018 PRESENT: Paul B. Carroll, Chairman Gregory L. Pando, Vice Chairman Gary E. Vinciguerra John R. McCourt, Alternate Also Present: Sharon Johnson, Recording Secretary Not Present: Charles J. Armando, Alternate Meeting Held in the Salah Hearing Room, 2nd floor, 801 Washington Street, Canton, MA Acting Chairman Pando opened the meeting at 7:00 pm and reads the agenda. Daniel O'Sullivan — 5 Valley Street — 26-18-SP-V(GP, Gy, PC) (continued from June 14, 2018) Chairman Pando opens the hearing and explains this is a continuation from June 14, 2018. Attorney Suzanne Matthews along with Mr. Daniel O'Sullivan explain they are seeking a favorable response to the petition that was filed to raze a dilapidated structure and replace it with a new two unit residential dwelling. The intention is to sell them as condominiums. Attorney Matthews states this has been an uphill battle. A Special Permit is needed for the use not a Variance under Section 8.0 of the Town of Canton Zoning By -Laws. She acknowledges this requires additional land. She explains they also need a Variance for the lot area. She understands why the Board takes this strictly and would not be interested in issuing a Variance. Attorney Matthews states if you look at this area of town, they are all very small lots and there are other dwellings in the area that have two units. They believe this will fit in with the neighborhood. They also believe this will fit in with the downtown area of the town and it will serve a good purpose. They are close walking distance to the town. Attorney Matthews states the Board has voted favorably for these types of things in the past. Attorney Matthews states the Board was provided a letter from 12 neighbors in the area in favor of this project. Attorney Matthews asks the Board to look at this with an open mind and listen to all of the abutters not just the opposition. Chairman Pando states he recalls the last hearing and confirms the Board has the letter Attorney Matthews referenced. He mentions quite a few abutters did sign the letter. He also states the current Library Director, Mark Lague signed the letter which he finds highly unusual. Attorney states she believes Mr. Lague does live in close proximity to the petitioners address. Chairman Pando states the major obstacle is a direct abutter from 6 Valley Street is opposed to the project. This is a single family district. This is a 8,000 square foot lot. Having a direct abutter opposed makes a very compelling argument. Chairman Pando states other areas of the town that have been approved are closer to the requirements. He explains the CCEOD district requirements have changed to make them more dense. From his standpoint he is opposed. Chairman Pando states he doesn't want people to believe they can let a small piece of property become this way and then just get approval to build a two family on this small of a lot. Mr. Paul Carroll states what is there now is in rough shape.
