Alex Zhang/CCAA Enterprise, LLC. — 454 York Street — 8-18-ENCB-SP-V Acting Chairman Pando opens the hearing and reads the petition. The project manager and designer for the job states this is a non -conforming lot with a lot of wetlands. He explains the existing dwelling is sitting on the hill. The owner of the property would like to raze the existing dwelling and construct a new single family dwelling. Chairman Pando asks if the petitioner has been to the Conservation Commission. Yes, they have the approval and have recorded it with the registry of deeds. Chairman Pando asks for a copy for the file. The petitioner hands in a copy to the Board. Chairman Pando states he is familiar with the property and the existing structure is small. Chairman Pando states from the look of the new plan you need relief on the front setback. Chairman Pando asks if the front porch is going to be open or covered. Covered with a roof. Chairman Pando goes over the setbacks that are required. Chairman Pando explains this is a unique parcel that has a lot of wetlands and issues with the topography and it creates a hardship because this is the only area of the property that you can build on. Chairman Pando asks if the only relief needed on the front yard setback. No, we also need relief on the height of the dwelling. Chairman Pando asks if the petitioner has an elevation for the proposed dwelling to show the height. The project manager hands in a set of plans to the Board and explains the height is 32.4'. Chairman Pando asks how the height was measured. The project manager explains the measured from the average grade to the top of the ridge. Chairman Pando explains the way the height of a dwelling measured. You only need to go to the midpoint of the ridge. That could change the number you have on the plans. Chairman Pando states the summary is relief on the front yard setback and now possibly height. Mr. McCourt concurs with the thoughts on the height issue and he has no problem with the relief needed from the front yard setback. Mr. Charles Armando states he has no issues with the request. Chairman Pando reviews the plans and explains the height issue is because the property drops off in the back of the dwelling. From the street it appears it is a normal height so there is no impact to the neighborhood.
