First Item on the Agenda - 2A6 YORK STREET STREET — (RESCISSION of a
Residential Three (3) Lot Subdivision on the Petition of Cary Will - (Suzanne
Matthews, Attorney)
Attorney Matthews introduced herself and explained that she represents Cary Will who has
purchased the property. In 2015, this property was approved for a three (3) lot subdivision
and the original applicants decided not to move forward. Mr. Will wants to build one (1)
single family home. Further, there was an easement which went along with the original
Approval of the Subdivision for a water line to the Elms adjacent property. The original
agreement between the Smith's and the Elms was not recorded, but Mr. Will has agreed to
honor the agreement and will connect the water line.
Abutter, Michael Elms of York Street, stated that he supports this rescission and hopes the
Board approves it.
A motion was made by Mr. Panico and seconded by Mr. Mitcheroney to close the public
hearing.
A motion was made by Mr. Panico and seconded by Ms. McDermott to Accept the Rescission
of the three (3) lot subdivision at 296 York Street. Motion Approved 5-0.
