A motion was made by Mr. Panico and seconded by Mr. Mitcheroney to open the public
meeting. Motion Approved 5-0.
First Item on the Agenda - MCKENDRY GROVE,/GREENLOII)GE STREET
Subdivision - Discussion with Owner, James LaMarr
Attorney Michael Khoury introduced himself and James LaMarr, owner of the development.
He explained that the binder course cannot be put down after November 15th under the
Rules & Regulations of the Town and State (the "DOT"). They would like to work with Tom
Houston and receive a waiver from the Planning Board with the following conditions: they
guarantee if they are allowed to put the binder course down, and the weather is around 40
degrees, and they do the work under the guidance of Tom Houston, they agree to fully
guarantee all of the work. This will also be reviewed again and any damage will be corrected
when the street is completed.
Mr. LaMarr explained that this will be beneficial and save substantial cost to the project if
this binder course can be put down now and not in the spring. He would like to come back
on December 20th for lot releases, if they can work within the conditions, and they will try to
the best of their ability to have all the water and utilities completed by that time. He will
work hand-in-hand with Tom Houston and his office. Further, Mr. LaMarr stated that he
"fully guarantees his work" and wants that to be placed in the record.
