location, date and subject matter to be considered by the Board of Health members for
voting. The proposed interim policy would allow the Board members to implement the
interim policy effective September 13 2016 as stated within the attached document -which
reads in the POLICY: section "3. Beginning on September 6, 2016, [ Revised to September
13, 2016] the Board will no longer issue any new Permits to Sell Tobacco in the Town of
Canton" (Exhibit A - attached). A vote of acceptance by the Board of Health will allow the
interim policy to begin as a policy, until the Board meets next to review and vote on the
updates to the "proposed amendments" which includes merging the interim policy into the
"Regulation of the Canton Board of Health Prohibition of the Sale of tobacco Products to
Minors." Copy attached. (Exhibit B).
The Board discussed the detrimental effects of tobacco products to individuals and the
importance of keeping tobacco products out of the hands of minors. Inquiries were made
by the Board members to the Director of Public Health regarding:
-Does the proposed policy address the transfer/sale of tobacco products if a business to a
family member and if not would it be addressed within the policy?
-Does the proposed interim policy as presented and or proposed amendments to the
regulation affect e -cigarettes and nicotine gum? The Director indicated yes as they are
nicotine delivery devices.
-Discussion to clarify/confirm the interim policy as presented would not allow a new
business owner to be able to sell tobacco products at a location which presently is
permitted to sell tobacco products. However, present established business owners will be
allowed to have the opportunity to renew their permits to permit to sell tobacco products
as long as they meet the guidelines written within the proposed interim policy and
proposed updated regulation.
The consensus of the Board members is the interim policy as presented makes sense and is
a compromise to totally banning tobacco products within the Town of Canton. The Boards
focus should be on the health of the individuals within the Town.
The Board decided after considerable discussion it would be best to vote on the interim
policy as it was presented to them this evening.
Upon a motion by Julie Goodman, seconded by Dr. Levrault, the Board voted to approve the
"proposed interim policy to implement a moratorium on issuing new tobacco sales permits
while continuing to renew existing tobacco sales permits" as written. Vote: 3-0.
Upon a motion by Julie Goodman, seconded by Richard Levrault, the Board voted to accept
the updates as presented within the "L. Violations: b) & c) portions of the Regulation of the
Canton Board of Health Prohibition of the sale of tobacco products to minors to be updated
from "an eighteen (18) months" to read "a twenty-four (24) month period". And in portion
"c)" the portion which reads permit shall be suspended for thirty (30) consecutive business
days" to read "and the permit shall be permanently revoked -as well as all the remainder of
