Paynico, Member Also Present: Thomas Houston, Professional Services Corporation Daren Lawlor, ]Manning Board Administrative Assistant Laura Smead, Town Planner Chairman Jeremy J. Comeau called to order the Planning Board meeting of January 18, 2017 at 7:00 P.M. Mr. Comeau explained that he is taking the Agenda out of order tonight. First Item on the Agenda - #110-#140 INDIAN LANE (Top Notch Development, LLQ, a Special Permit Application seeking approval of an eight (8) lot flexible development ANR residential subdivision as shown on Assessors Map loo, Parcels 16,162-165 located in the Single Residence "AA" District (Paul Brodmerkle, Site Design) Mr. Brodmerlde explained that they have responded to the Peer Review Reports and the only issue is Item #5 regarding the Roadway 175 offset. The proposed road would require a waiver from Section 3.4.6.5 which prohibits street jogs of less than two hundred and twenty five (225') feet between street intersections whether on the same or opposite side of the street. The Anthony Way centerline -to -centerline distance is approximately 165 feet from the proposed road. The Town Clerk certified that Anthony Way is not a public way during the preliminary review process. The Board agreed that it is little more than a 10 -foot right-of-way and a narrow easement allowing a 16 -foot driveway, which does not constitute a roadway in Canton. The issue of if Anthony Way being a street was discussed with Lisa Grega on the Engineering Department and it is a public way not a street. The criteria for a street is that it has to meet the following requirements: (1) is it a public way; (2) was it approved by the Planning Board (ANR) — right-of-way; and (3) was it approved prior to Zoning and Planning By -Laws. Also, this never went through Subdivision Rules & Regulations. The intent is 225'; and is it a street, and the answer is no. The Applicant came before the Planning Board for a Preliminary Subdivision and it was approved 5-0. Since that has been put to rest, the Applicant is moving ahead with a Definitive Plan.
