Minutes
Board of Selectmen
May 3, 2016
Memorial Hall - Salah Meeting Room
Present: John J. Connolly, Chairman, Robert E. Burr Jr., Vice-Chairman, Kevin T. Feeney, Clerk, Victor D.
Del Vecchio, Member, Mark Porter, Member, Jennifer Kemalian, Administrative Secretary.
Meeting was called to order at 7:05 p.m.
Attorney Dick Staiti was present at the meeting to discuss the conveyance of land from Brightview,
Canton LLC to the Town of Canton. It was noted that Maria Miller, CEO of Shelter Development Group
was also present at the meeting. Attorney Staiti noted that he had been working together with Bill Friel,
Town Administrator and Lou Ross, Town Counsel, to come to an agreement on the conveyance of 13
acres of land from Brightview LLC to the Town of Canton. He noted that with him he had a (Brightview)
signed deed, a letter of good standing, a seventy five dollar check to cover the costs of recording the
deed and an escrow letter.
Mr. Del Vecchio noted that there was also a letter of support from the Town of Canton to Brightview.
He suggested a few changes to the letter and to the deed to further explain the intent of each. He
noted that he did not agree with the land being restricted to only passive use and recreation.
To clarify, Mr. Del Vecchio suggested that in the letter of support, the words"open space and
recreational" be deleted and "its use" to be inserted after the words "13 acres of such land to the Town"
into the first paragraph.
He also noted that he would like the deed amended by inserting the words "Structures and
I mprovements related to other" inserted before the word purposes in the second paragraph after the
number 5.
Attorney Staiti and Ms. Miller briefly conferred and then agreed that the changes would be amenable.
Ms. Miller spoke briefly about Brightview Senior Living Facility and thanked that Board for its support for
the project.
Mr. Porter raised the issue of making any of the motions of the Board that evening contingent upon the
land having no significant environmental issues. Ms. Miller and Attorney Staiti noted that the land had
been inspected and cleared. Mr. Connolly noted that the Town could exercise its right to examine the
land at its own expense prior to conveyance.
A motion was made as follows:
1. The form of the deed, as modified by the Board of Selectmen, be approved;
2. the escrow letter agreement from Brightview, Canton, LLC be executed by the Board or its Chairman;
