Hearing called to order by Chairman Sundin at 7:10 P.M. 
PUBLIC HEARINGS 
Joseph & Kara Kubiak 12 Villagegate Rd. RDA-5-15 
Installation of 24' by 25' swing set/ play area, installation of 10' by 15' shed 
and repairing/filling in of existing in-ground pool within 200' Buffer Zone of 
existing stream and Bordering Vegetated Wetland. (Map 102, Lot 27) 
Presented by homeowner Mr. Joseph Kubiak 
• Mr. Kubiak explained he was not aware of existing stream and wetlands at rear of 
property. 
• Proposing to install 24'x 25' play area with swing set, 10'x15' shed and 
repair/removal of existing in-ground pool. 
Agent O'Connell - 
Requests no further expansion of rear yard area and tree stumps to be ground 
down not removed. 
ConCom — 
Asking when pool would be removed, Mr. Kubiak explained not sure, getting 
estimates to repair or remove existing pool. 
Agent O'Connell recommends Determination of Applicability RDA-5-15 with special 
conditions. Agent read special conditions into record including special condition tree 
stumps to be ground down to be added. 
Motion Made by Robert MacDonald issue Determination of Applicability 
RDA-5-15 with special conditions including tree stumps be ground down not 
removed for 12 Villagegate Road. 
Gerald Carmichael Vote: 6-0
