Zoning Board of Appeals August 11, 2011 meeting Page 1 of 7 Present: Chairman Paul B. Carroll, Greg Pando, John Marini. Also present: Alternate: Kevin T. Feeney, and Velma Coffey, Recording Secretary & Admin. Asst Chairman Carroll called hearing to order at 7:03 P.M. SCHEDULED HEARINGS Tara Lynch Trustee/Lynch Family Irrev. Trust – 33 Pleasant St Petitioner would like to split property into 2 lots. Needs variance for build factor, frontage, lot width. Chairman Carroll reads the petition. This is a Single Residence A District. Tara Lynch and her attorney, Richard Staiti appeared before the Board. Atty. Staiti presented a memorandum and read it into the record. They had a new plan and presented it with the memorandum. (Exhibit B). Exhibit A was submitted originally with the application, but the new plan shows changes. Chairman Carroll stated it is a beautiful house. By-law Section 4.1.4 spell out the frontage, clearly 100ft on Pleasant St. down to 72 ft in the middle. Atty. Staiti spoke to Ed Walsh, the Building Commissioner, but he could not find referenc e to what Ed said, in the By-Laws. He questions what Ed said. Chairman Carroll said you spoke to Ed, he feels 100ft through the lot. Ref: 4.2.2 from 2008 By Laws. Do you have any idea what the proposed house looks like. We would review the house plans so they will duplicate the style of the neighborhood. I am not satisfied on the frontage issue yet. Less worried about build factor. Those are my issues. Mr. Pando said looking at the parcel, it is a sizable piece of land. Did you have Sharon survey look at the land if the house was not there, or moved. Tear down building to build a new house, or move existing. You set yourself up. Mr. Marini said he would like to hear the objections of the abutters. Maybe something could be worked out. Chairman Carroll reads abutters letters. Mr. Pando said they are using 2008 By-Laws, we are now using 2010 By- Laws. Mrs. Clifford, 1403 Washington St. stated there is no restriction on my deed, I have 10,000 s.f. the proposed house is in my back yard. 34ft to the line plus the 35ft on their plan (69ft) We live on Washington St between Dedham and Pleasant, and it is a difficult street, we value our space. To have this would be a hardship for us. Peter Hennessey – 4 Sumner St. said they sold his mother’s house at 1395 Washington St. We appreciate Mrs. Lynch’s difficulty, there is a small market that wants a house like that. We sold my mother’s house at a price substantially less (25%). I understand, but if a house is overpriced, it is not going to sell. Putting a lot in there is a hardship to the neighbors. Chairman Carroll stated we would make no decision on this tonight. The Board would like to make a site visit, and talk to Ed Walsh. We th will continue this to Sept. 8 meeting.
