Minutes of the meeting of April 10, 2008

Chairman Carroll opened the meeting at 7:05pm in the Salah Hearing Room, Memor ial 
Hall. 
 
Criterion – Windsor Woods 
. The Board received a letter from Conservation 
Commission member Robert Murphy stating that the Conservation Commission was 
satisfied with all issues that were previously outstanding. Chairman Carroll also read a 
letter from Building Commissioner, Edward Walsh, stating that it appears that all of the 
conditions listed in the comprehensive permit issued to Pequit Development Partners, 
LLC have been satisfied. (letters are in zoning file) Final Occupancy Permit issued an d 
given to Bob Murphy. He accepted a check from Meredith West, attorney from Mr. 
Freeman’s office, (for Criterion Canton Apartments) for over $69K. This mitigation sum 
is needed to finish work on Wardwell Rd. This project should be completed in 4-6 weeks. 
Was the easement recorded asked Chairman Carroll. Mr. Murphy stated that it had been 
recorded. Chairman Carroll stated that it appears that Town Counsel, the Conservation 
Commission and the Building Commissioner were all satisfied. Ms. West said tha t what 
she was seeking at this meeting was a finding to the effect that all issues were satisfied 
and in compliance with the Comprehensive Permit. Mr. Pando stated that according to 
780CMR, (Massachusetts State Building Code) the occupancy permit would cover that. 
Mr. Fitzgerald said that the occupancy permit is as much as we can give you. We do not 
have the power or authority to do this. Chairman Carroll asked Ms. West to fax 
something to us as to what findings she wanted. Town Counsel’s advice is need. Mr. 
Pando deferred to the Chairman. If Ms. West wants more formal finding, please put it in 
writing. Mr. Pando stated that to the best of our knowledge, we allow issuance of the 
Certificate of Occupancy, we release the Building Commissioner to releas e the 
Certificate of Occupancy. Mr. Fitzgerald agreed. At that point, Chairman Carroll handed 
the Certificate of Occupancy to Mr. Murphy.
