Salvatori, Jr., Member, John J. Connolly, Member, William T. Friel, Town Administrator, Jennifer Andrews, Administrative Secretary. Meeting was called to order at 7:05 p.m. Class H License Hearing — Byblos Industries Corp located at 1158A Washington Street, Joseph Rouhana Motion was made to open the hearing. Motion: Mr. Burr Second: Ms. Elkort Vote: 5-0 Mr. Friel, Town Administrator, recommended continuing the hearing due to the fact that the property owners filed a petition with the Zoning Board of Appeals and it is still pending. Additional Zoning Approval is necessary for these owners to obtain the Class II License. Motion was made to continue the hearing. Motion: Mr. Burr Second: Ms. Elkort Vote: 5-0 2011 ATM Article 39— Massachusetts Community Preservation Act — Deb Sundin, Bruce Rohr, Conservation Commission Members of the Conservation Commission came before the Board to discuss the Conservation Commission sponsored article for the Massachusetts Community Preservation Act. Ms. Sundin, Conservation Commission member, discussed the merits of the Town Adopting the Act. She explained that it needed to pass Town Meeting in order to be considered as a ballot question. She explained that it could be thought of as a savings account that the State matches a certain percentage of whatever the Town puts in and the funding is to be used for land preservation (open space or historical preservation) or affordable housing. She noted that the cost to the average tax payer would be about $40 to $42 a year and that certain low income households would be exempt. She noted that a similar article had passed at the 2006 Annual Town Meeting but it had failed at the ballot. She was asking for the Board of Selectmen's support. Mr. Connolly noted that the Town has acquired a lot of open space, such as the Williams Estate and the Pequitside Estate Estate without assistance from the Community Preservation Act. He noted that he was uneasy about the program as it gives the state a certain amount of control of what the Town can do with the property once it has been acquired and no Town Meeting decision on parcel acquisition was then required. A committee would decide. Deb Sundin and Bruce Rohr, Conservation Commission member, reiterated the fact that the Town's funds will be matched by the state and therefore the Town would only have to spend half the money on these kinds of projects. Ms. Sundin also noted that the Town would be committed to continuing with the program for five years, but could opt out after that time frame. Mr. Del Vecchio inquired if the funds could be used towards maintenance such as field or sod replacement, or new sod for artificial turf at the High School. Ms. Roth, State Community Preservation Act Associate Director was also present and explained that the funds cannot be used for maintenance, rehabilitation of an existing outdoor facility or for artificial turf. There was a brief discussion among the Board members concerning supporting the article and that state "matching" funds have been dwindling and maybe unreliable in the future. The Board noted that it would make a decision prior to Annual Town Meeting whether of not to support the CPA.
