1. MINOR MODIFICATION OF CEDARCREST VILLAGE SUBDIVISION
LANDSCAPE PLAN-THOMAS SALAH/SUZANNE MATTHEWS, ESQ.

Roger Cook the Landscape contractor was also present.
Atty. Matthews gave the basic details of the issue. Two sketch sheets were available. One shows
Cedarcrest Path and the other is Cedarcrest Road. The trees required are to go on a strip of land
between the sidewalk and the street. The plan also calls for 3 Y2" caliber trees. They consulted with
the Tree Warden, Mr. Pasquarossa, who supports the modification with a letter presented before the
Board. Mr. Cook explained that the trees chosen at approval time, won't fit. He explained the
minimum standards for size of the ball of the tree when a tree is dug. The problem they have is
that they are taking a 3 Y2" caliber tree and putting it into a small space. It will not do well.
Another situation is that in your specifications, the trees are measured three feet from the ground.
That is a forestry specification. The correct application for a 3 Y2 " caliber tree is measured six
inches above the ground. The listing of trees that he received is more of estate trees.

Mr. Jenkins asked about the root system, and if you can put the trees in before the sidewalks are
paved. Mr. Cook stated yes. Mr. Jenkins asked if the trees would die when you pave over it. Mr.
Cook stated that you will not pave over the ball. Mr. Jenkins feels that there is another option, to
move the sidewalk out to the curb line. Mr. Jenkins asked what the icing and snowplowing will do
to the grass. The sand that collects around the ball of the tree will be part of the maintenance plan
of the association.

Mr. Miller asked about the sidewalks required in this subdivision. Atty. Matthews answered that
there are sidewalks on one side for Cedarcrest Road, and both sides for Cedarcrest Path.
On Cedarcrest Path you have 3 Y2 'between the street and the property line. You need to center the
tree in that space.

Mr. Miller amended the motion to keep the same size caliber of trees where there is no sidewalk
and on Cedarcrest Path to allow 2-2 Y2 " caliber trees to be used in the space shown on the plan,
and on Cedarcrest Road to allow 2 W' -3" caliber trees to be used in the space shown, seconded by
Mrs. Hayes. No discussion.
Upon a motion by Mr. Miller to amend the motion and seconded by Mrs. Hayes, the Board
voted 5-0 in favor.
The main motion cancelled out.

Attorney Matthews brought another matter to the Board's attention. She brought a letter to the
Board concerning construction observations relating to Cedarcrest Subdivision. Mr. Jenkins just
read it yesterday, and wanted to prepare a response to it. Atty. Matthews would like a full
understanding between the parties as to what is occurring. She could save it for discussion to
another date. Mr. Jenkins took objection to her statement about affordable housing. One issue is
simply a developer pays for services to the Town. The problem is in the process, she stated. She
would like to see this discussed with the Board, not in a hostile environmental.
Another issue was the cost of writing up the observation and charging for that. Maybe that should
be looked at, Atty. Moynihan suggested.
Mr. Miller suggested that it be on an agenda for another evening; perhaps on the workshop agenda.
Atty. Matthews asked who to contact to see when this would be on an agenda. Mr. Jenkins would
like her to contact him.
She thanked the Board.

2. 7:30 P.M. SCENIC WAY PUBLIC HEARING-363 CHAPMAN STREET
SUBDIVISION PAUL FELDMAN/PAUL SCHNEIDERS, ESQ.

Upon a motion made by Mr. Comeau and seconded by Mrs. Hayes to open the Public Hearing,
for 363 Chapman Street, the Board voted 5-0 in favor.

Upon a motion made by Mr. Comeau and seconded by Mr. Miller to waive the reading of the
Public Hearing, the Board voted 5-0 in favor.

Atty. Schneiders spoke about the approved subdivision where this tree is in located in the middle of
the road which is to be built. It is a tree that has to be removed, but Atty. Schneiders stated they
will replace it. 40 trees are on the new plan to be included in the subdivision.
Mr. Feldman will replace the tree.
Upon a motion made by Mr. Comeau and seconded by Mr. Connolly to approve the removal of
a tree on 363 Chapman Street, the Board voted 5-0 in favor.
Upon a motion made by Mr. Comeau and seconded by Mrs. Hayes to close the Public Hearing,
the Board voted 5-0 in favor.

3. ANR PLAN-133 NORFOLK ST.-KELLEHER/NALLY, ATTY. PAUL SCHNEIDERS,ESQ

Originally, Mr. Kelleher wanted to put another house on the lot. But that would result in seeking a
variance from Zoning, and a neighbor objected to it. So, they decided to divide the empty property
in half and put Parcel A to Mr. Reardon's property, and Parcel B to the other property. This is for
conveyance purposes only.
Mr. Comeau is glad that someone is not wanting to build on a lot even though they can, thus
preservmg green space.
Upon a motion made by Mr. Comeau and seconded by Mrs. Hayes to endorse Plan of Land on
Norfolk Street dated September 18, 2006, the Board voted 5-0 in favor.

Atty. Schneiders was asked about the naming of the new street off 363 Chapman Street.
