Discussion: A member of the audience, Shirley Morse, spoke to the matter of the fine. She stated the Law states that triple that amount can be fined, if he willfully cut down the tree. Mr. Miller motioned to amend the motion and fine the maximum amount that we are capable of fining; seconded by Mrs. Hayes. Mrs. Morse stated that another alternative would be to ask him to plant two four inch caliber trees in that area and maintain them. Mr. Comeau noted that we should send a letter to the Board of Selectmen advising them of our decision and urge them to hold a Public Hearing and take appropriate action. Mr. Miller thought that perhaps we should keep the fine of $100. in place and compel Mr. Kirkpatrick to plant shade trees. Upon a motion made by Mr. Miller and seconded by Mrs. Hayes, to amend the motion to keep the fine at $100. and request that Mr. Kirkpatrick must plant two shade trees of 3 1/2"-4" caliber of similar type trees. Mr. Miller withdraws his second amendment motion. Upon a motion made by Mr. Miller and seconded by Mrs. Hayes to levy the maximum fine allowed under the Planning Board By-laws, and MA General Laws, the Board voted 4-0 in favor.
