Minutes of the Meeting of November 4,2004.

PRESENT:

Paul B. Carroll, Chairman
James F. Fitzgerald, Jr.
Gregory L. Pando

ALSO
PRESENT:

Sue Franco, Recording Secretary

Mr. Carroll opened the Meeting at 7:00 p.m. in the Salah Hearing Room,
Memorial Hall.

Dorothv Borman - 380 York St.

Attorney Schneiders came before the Board representing the petitioner. He
submitted a letter requesting a withdrawal without prejudice of the petition.

Mr. Fitzgerald moved to allow the withdrawal without prejudice. The move was
seconded and the Board voted unanimously to allow.

John Haiiar - 140 York St.

Attorney Paul Schneiders came before the Board representing petitioner. Mr.
John Hajjar was also present.

Attorney Schneiders stated the petitioner wishes to construct a house with a total
height of 28.5'. There are substantial wetlands on the site so the house has to be located
120' from the rear lot line and 80' from the side property line and 60' from the front
property line. The petitioner has a hardship because he could locate his house further
back on the lot and have the 28.5' height as of right, but the wetlands prevent him from
doing that. Attorney Schneiders stated most of the houses in the area are very large and
exceed the 25' height requirement. The proposed house would be 36' wide, which
generally calls for a higher roof. Large rooms usually have higher ceilings.

Mr. Carroll asked if the property abuts Pequit Brook.

Attorney Schneiders stated he is not sure.

Mr. Carroll stated the petitioner is lucky to get a house on the lot at all with all the
wetlands.
