Minutes of the Meeting of January 29, 2004.

PRESENT: Paul B. Carroll, Chairman
 James F. Fitzgerald, Jr.
 Gregory L. Pando

ALSO
PRESENT: Attorney Mark Bobrowski
 Sue Franco, Recording Secretary

Mr. Carroll opened the meeting at 7:00 p.m. in the Salah Hearing Room,
Memorial Hall.

Pequit View and Pequit Villaze

Mr. Carroll stated there is litigation currently pending before the Housing Appeals
Committee regarding the above-referenced petitions. He stated generally speaking the
HAC favors the applicants in cases of denials. The town has engaged in discussions with
the petitioner and, although the town is not in favor of Ch. 40B projects because they are
contrary to the zoning by-laws, they realize that a compromise may be the best solution.
He stated the Board cannot take in any further evidence as the hearings have been closed,
but they will hear from the Board of Selectmen and special counsel for the town, Mark
Bobrowski.

Attorney Bobrowski stated he would begin with the Pequit View proposal. The
proposal is for eighty-four units, four of which would be single family homes and eighty
of which would be condominium units. The single family homes would be isolated from
the condominium units by a 150 foot buffer with no pedestrian or vehicular access
whatsoever. There would be 21 units of affordable housing in the condominium complex
and the single family homes would be market rate, for a total of 25% affordable housing
for the project. Seventy percent of the affordable units would be set aside for current
Canton residents, parents or children of current Canton residents and municipal
employees. All affordable units would be owner-occupied and the condominium
complex would be exclusively private with no town maintenance. The four single family
homes would be constructed on a road which will be public. Prior to approval from the
Building Department, the applicant would submit landscape, lighting, utilities, storm
water management, and road design plans to the ZBA. The Board may fine tune the
proposal during that process. The applicant will pay all local applicable fees for all
construction. The applicant will provide the following: $250,000 as a gift which will be
under the control of the Board of Selectmen, $25,000 for the purpose of making
