Minutes of the Meeting of July 22, 2004.

PRESENT: Paul B. Carroll, Chairman
 James F. Fitzgerald, Jr.
 Gregory L. Pando

ALSO
PRESENT: Sue Franco, Recording Secretary

Mr. Carroll opened the Meeting at 7:00 p.m. in the Salah Hearing, Memorial Hall.

John Cruznale - 250 Bailey St.

Attorney Michael Curran came before the Board informally representing the
petitioner. He stated there is a proposed tenant for the property at 250 Bailey St., and he
is requesting an opinion of the Board as to whether a special permit would be needed to
allow the tenant. The proposed tenant is AAA and they would use the property for a 24-
hour a day dispatch center for tow trucks. The disabled cars would not be brought back
to the site, the site would be primarily to house the dispatch center and for tow truck
parking. The vehicles to be parked on site would consist of tow trucks, pick-up trucks,
and ramp trucks. The towing vehicles would be housed inside the facility and the
employees' vehicles would be parked outside. The towing vehicles would be maintained
and repaired on site, however, no customer vehicles would be brought to the site or
repaired there. Attorney Curran asked whether the Board feels the proposed use would
be permitted due to a prior decision or would require a special permit.

Mr. Carroll stated he would require further time to review the prior decisions and
Attorney Curran's brief before giving an opinion. He stated if a special permit was
needed, a formal hearing would be required.

Mr. Fitzgerald stated he agrees with Mr. Carroll. He stated there would have to
be some guidelines for a 24-hour a day operation. He stated the site has been a problem
in the past because of the number of vehicles located there. He would require to see a
site plan showing that there is ample parking to accommodate employee vehicles and the
work trucks if the petitioner was to go forward with a hearing.

Mr. Pando stated they would possibly need 10-12 employee spaces and 8-10 tow
truck spaces.
