The removal of earth material necessarily excavated in connection with the lawful construction of a building or structure, or of a driveway, parking lot, sidewalk or path incidental to any such building or structure, provided that the quantity of material removed does not exceed that actually displaced by the portion of building, structure, driveway, parking lot, sidewalk or path below finished grade. All plans required to be filed under this Section shall be prepared and certified by a duly licensed engineer. Failure to file with the SPGA any such plans prior to conducting any earth removal operations shall constitute a violation of this Section.
